You must be at least 18 years old to use Benevolo.

When creating an account, you agree to:

You are responsible for ensuring your organization’s use of the platform complies with applicable laws and regulations.


2. Use of the Services

Benevolo provides digital tools including CRM, websites, forms, automation, communications, and related services.

You agree to use the Services only for lawful purposes and not to:

Violate any applicable laws or regulations

Infringe upon intellectual property rights

Upload malicious code or harmful content

Engage in spam, abuse, or deceptive practices

Attempt to access systems or data without authorization

We reserve the right to suspend or terminate access for violations of these Terms.


3. Nonprofit & Client Data

Organizations using Benevolo may collect and manage data related to donors, supporters, volunteers, or clients.

Benevolo acts as a service provider / data processor

The organization remains responsible as the data controller

Users must obtain proper consent for communications (email, SMS, voice, etc.)

Benevolo is not responsible for how organizations use or manage their data.


4. Communications, SMS Messaging & Consent

A. Description of SMS Use Cases

Benevolo enables users to send and receive SMS messages for permitted business and service-related purposes, including but not limited to:

Appointment confirmations and reminders

Scheduling updates and notifications

Customer or client support communications

Service-related alerts and account notices

Benevolo does not permit unsolicited messaging or unlawful marketing practices.


B. Consent & Compliance

Use of SMS, voice, email, or other communication tools must comply with all applicable laws and regulations, including:

Telephone Consumer Protection Act (TCPA)

CAN-SPAM Act

CTIA guidelines

State privacy and consent laws

You are solely responsible for:

Obtaining explicit recipient consent

Message content and timing

Maintaining consent and opt-in records

Benevolo is not liable for violations arising from improper or unlawful use.


C. Opt-Out Instructions

Recipients may opt out of SMS messages at any time by replying “STOP” to any message.

Opt-out requests must be honored immediately

A confirmation message may be sent to acknowledge opt-out

Messages may resume only if the recipient explicitly re-opts in

Recipients may reply “HELP” for assistance.


D. Message Frequency & Rates

Message frequency varies based on service usage and interactions

Message and data rates may apply, depending on the recipient’s mobile carrier and plan


E. Carrier Liability Disclaimer

Wireless carriers are not liable for delayed, undelivered, or misrouted messages.


5. Call, Audio & Video Recording

Benevolo may record phone calls, video calls, screen shares, or virtual meetings, including audio and video content, for purposes such as:

Quality assurance

Training and internal review

Customer support

Security, compliance, and dispute resolution

By using Benevolo’s communication features or communicating with Benevolo representatives, you consent to such recording where permitted by law.
Where required, additional notice or consent mechanisms will be provided in accordance with applicable state and federal laws.


6. Payments, Subscriptions & Billing

Certain Services require payment.

By subscribing, you agree that:

Fees are billed according to your selected plan

Payments are non-refundable unless otherwise stated

Benevolo may change pricing with notice

Failure to pay may result in suspension or termination

Third-party payment processors may be used and are governed by their own terms.


7. Intellectual Property

All Benevolo content, software, branding, and materials are owned by or licensed to Benevolo and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services for your organization’s internal purposes.

You may not:

Copy, resell, or sublicense the platform

Reverse engineer or attempt to extract source code

Use Benevolo branding without permission


8. Third-Party Services & Integrations

Benevolo integrates with third-party services (e.g., hosting, payments, email, SMS, analytics).

We are not responsible for:

Third-party availability or performance

Data practices of third-party services

Losses caused by third-party providers

Use of third-party tools is subject to their terms and policies.


9. Service Availability & Modifications

We strive to maintain reliable service but do not guarantee uninterrupted access.

Benevolo may:

Modify or discontinue features

Perform maintenance

Update or change Services at any time

We are not liable for service interruptions or feature changes.


10. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, Benevolo disclaims all warranties, including:

Fitness for a particular purpose

Non-infringement

We do not guarantee specific outcomes, results, or performance.


11. Limitation of Liability

To the maximum extent permitted by law:

Benevolo shall not be liable for indirect, incidental, or consequential damages

Our total liability shall not exceed the amount paid to Benevolo in the preceding 12 months

13. Termination
